Temporary Work Permits Under the International Mobility Program
Under the Canadian International Mobility Program, the intra-company transferees category allows multi-national companies to temporarily transfer qualified employees and professionals to Canada for management needs and expansion purposes focusing on improving Canadian exports as well as reinforcing a company’s competitiveness in international markets while benefiting its Canadian operations.
It is imperative to know that the intra-company transferees category is subject to both Canadian immigration regulations, and the provisions of international trade agreements as well. When an applicant from any country, including participants in the General Agreement on Trade in Services, or countries that signed free trade agreements with Canada such as NAFTA, qualifies as an intra-company transferee, a work permit may be obtained. However, because such applicants are expected to provide significant economic benefit to Canada with the transfer of their expertise and skills to the Canadian market, they are exempt from the Labour Market Impact Assessment (LMIA). Qualifying job positions under this category include, executives and senior managers, functional managers, and specialized knowledge workers. Some of the requirements to qualify for a temporary work permit in Canada under the intra-company transferees category stipulate that the applicant must be currently employed by a multi-national company and will be transferred to a parent, subsidiary, branch, or affiliate of the same organization. Adjudicating the application takes into consideration the length of the transferee's employment with the company prior to the transfer as well as the duration of temporary employment in Canada.
