U.S. Immigrant Visa Categories

U.S. Permanent Residency Options
Some foreign nationals can be admitted to the U.S. as lawful permanent residents under various categories ranging from employment-based immigrant visa petitions for those who are most accomplished in their field to business investor visas. Most of the immigrant visa categories do not require labour certification while investors in particular do not require employer's visa petitions. At New Era Immigration we specialize in 4 categories that allow foreign individuals to apply for permanent residency or Green Card in the U.S.:
  • EB-1 visa (Extraordinary ability in the sciences, arts, business, or sports; exceptional academics, professors or researchers; and multinational business executives): This is an Employment-based immigration petition without the Labor Certification requirement in the Green Card process.
  • EB-2 visa (Members of the professions with advanced designations or for individuals with outstanding ability in the arts and sciences, or business): This immigrant visa category requires an employment offer, except for those who are able to demonstrate that granting them Green Card or lawful permanent residence is in the U.S.'s national interest.
  • EB-3 visa (Professionals, skilled workers, and other workers): Requires the applicant to have a permanent, full time job offer from a U.S. employer for which qualified workers are not available in the United States. The Green Card holder's spouse and dependent children may be eligible to accompany the applicant and become permanent residents of the United States.
  • EB-5 visa (Business investors): This category does not require an employment offer from a U.S. employer, nor does it require a labor certificate in the Green Card process. However, the EB-5 visa is subject to conditional permanent residence for 2 years before allowing the applicant to gain lawful permanent residency. The investment funds range between 0.5 million USD targeting rural and high unemployment areas to 1.0 million USD and depending on the nature of investment. The investment which does not have to involve starting a totally new business should have created a minimum of 10 full time U.S. jobs within two years of entering the U.S.
