Labour Market Impact Assessment

Assisting Professionals & Corporations with Temporary Work Permits for Canada

Labour Market Impact Assessment (LMIA)

An Important Prerequisite to Hiring Foreign Workers or Obtaining Their Work Permits
When a company or an employer in Canada wishes to hire a foreign professional or worker to work in Canada, a Labour Market Impact Assessment (LMIA) document is usually required to show whether or not the current Canadian workforce in the Canadian labor market can supply the employer with a qualified candidate. The LMIA must be filed before the foreign professional or worker submit a work permit application.

The LMIA, when approved, is considered a permission from Employment and Social Development Canada that authorizes the employer to hire a temporary foreign professional or worker.

A Labour Market Impact Assessment (LMIA) can be filed to hire professionals or workers in various fields such as in film and entertainment occupations, academic positions at a degree-granting post-secondary educational institution, and under the Seasonal Agricultural Worker Program or the Agricultural Stream.

An LMIA is considered one of the main requirements to obtain a work permit in Canada. Some of the other requirements are a job offer letter, and a contract. Moreover, Labour Market Impact Assessment can be filed before a foreign professional or worker are identified but restrictions may apply.

To know more about how to submit a LMIA, the type of work permit an applicant can obtain, the steps an employer or a company need to pursue before a work permit application is submitted, or if your LMIA/work permit application has been denied, please contact us to schedule a legal consultation*.
